1. Who we are

2. Using our website

You may use our website for lawful purposes only. You agree not to misuse it, attempt to gain unauthorised access to any part of it, or use it in a way that could damage or disrupt it. We may update, suspend or withdraw any part of the site at any time.

3. Our community activities

Some activities, such as the Run Club and coffee mornings, are run by The Mood Booster and are usually free to join. Where an activity has its own rules or requires a waiver, those apply in addition to these terms. You take part in physical activities at your own risk and are responsible for making sure any activity is suitable for you. If in doubt, speak to a medical professional first.

4. Certification

Our certification programme recognises organisations that put genuine wellbeing practices in place for their people, across bronze, silver and gold tiers.

• Applying. Applying does not guarantee certification. We assess each application on its merits and may ask for further information or evidence.
• Assessment. Certification is awarded at our discretion, based on the standards for the relevant tier. We may decline an application or award a different tier from the one requested.
• Use of the mark. If certified, you may use the Mood Booster Certified mark in line with any guidance we provide, only for the certified organisation, and only while your certification is valid. You must stop using it if your certification ends.
• Re-verification. Certification is valid for twelve months and is subject to annual re-verification. We will contact you before it is due.
• Withdrawal. We may suspend or withdraw certification if the standards are no longer met, if information provided was inaccurate, or if the mark is misused.

5. Fees and payment

• Certification is charged as an annual fee, confirmed to you in writing before any work begins.
• Payment will be taken securely through Stripe once online payments are enabled. Until then, fees are invoiced directly.
• Fees are non-refundable once assessment work has begun. If we have not started assessing your application, we will refund any fee paid.
• Certification does not renew or continue unless the annual fee for the next period is paid.

Nothing in this section affects any statutory rights you may have as a consumer.

6. Intellectual property

The content on this site, including text, graphics, logos and the Mood Booster Certified mark, belongs to The Mood Booster Ltd or its licensors and is protected by law. You may not copy, reproduce or use it without our permission, except as expressly allowed under these terms.

7. Our liability

We provide our website and community activities in good faith and take reasonable care over our certification assessments. To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for loss arising from your use of the site or reliance on its content.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

8. Privacy

We handle personal data in line with our Privacy Policy and our Cookie Policy.

9. Changes to these terms

We may update these terms from time to time. The version on this page is the one that applies. We will change the date at the top when we make an update.

10. Governing law

These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
